On April 11, 2018, Cetrulo LLP hosted the Massachusetts Defense Lawyers Association (MassDLA) discussion on recent developments in opioid litigation in Massachusetts and nationally. The discussion was led by Eric Gold, Chief of the Health Care Division at the Massachusetts Attorney General’s Office, and Cetrulo LLP partner Kyle Bjornlund.
Mr. Gold provided background on the opioid epidemic and the Massachusetts Attorney General’s continuing efforts to address the crisis through public education and law enforcement. Mr. Gold additionally briefed the attendees on the recent settlements with Amphastar Pharmaceuticals (regarding Naloxone pricing) and Insys Therapeutics (regarding Subsys marketing scheme), and emerging concerns associated with patient brokering and treatment fraud.
Mr. Bjornlund discussed the multi-district litigation consolidated in the United States District Court for the Northern District of Ohio, which names various opioid manufacturers, distributors, and key opinion leaders. He provided insights into the legal theories driving the litigation and the status of MDL 2804.
